People with major unsecured debt problems can apply for an Individual Voluntary Agreement or IVA to eliminate their debts. To be eligible for an IVA you need to owe to at least three different creditors the total amount of over £15,000 and have at least £200 monthly amount to manage your IVA payments. An IVA is a legally binding agreement between debtors and creditors, usually over a 5 years’ period of time, during which debtors will repay a part of the owed debt and the remaining amount will be written off. During the IVA creditors and collection agencies cannot harass debtors; they will be contacting the Insolvency Practitioner, who is continuously communicating and acting between debtors and creditors. To start with, fill in an online IVA application form and wait for information and an Insolvency Practitioner to contact you.
When you are in an Individual Voluntary Agreement your case is listed in an IVA Register, as a matter for the public record on the Insolvency Services. The IVA register gives numerous details, including a full list of BROs (Bankruptcy Restriction Orders), FTVAs (Fast Track Voluntary Arrangements), a list of all current IVAs, a list of bankruptcies, which have ended in the last 3 months or are still on and a list of Bankruptcy Restrictions Undertakings. Near these details, there are some typical, personal details included into the IVA register, such as the name, last know address, date of birth and occupation of the debtor, details on the Insolvency Practitioner and details on the IVA arrangement.
The IVA register also known as Individual Insolvency Register is an issue of public record, being available for everyone to view it. Usually there is general information in this record, headline information covering the essentials without giving details of specific case particulars. Everyone can access these IVA registers or the Insolvency services website at www.insolvency.gov.uk.
